Terms for creators
Terms of the Zest creator base

These terms apply when you join the Zest creator base at connect.loyalz.io/dolacz. Joining is free and commits you to nothing. What we do with your data is described in Part C of the privacy notice.
1. What the creator base is
A list of content creators (influencers and UGC creators) that the Zest agency keeps so it can propose them to brands. The brands are clients of Zest and of the Loyalz platform. When one of them needs creators for paid UGC videos or publications, we search the base, and your profile may end up on the shortlist we show them.
2. Who runs it
ZEST sp. z o.o., Szatonia 28A, 95-070 Aleksandrów Łódzki, entered in the register of entrepreneurs of the National Court Register kept by the District Court for Łódź-Śródmieście in Łódź, XX Commercial Division, under KRS 0000945420, NIP 7322206426, REGON 52092903500000, share capital PLN 5,000.00 (“Zest”, “we”), the agency behind zest.agency. The base runs on Loyalz (loyalz.io), the platform Zest builds and uses for its work with brands and creators. Questions go to karol.majewski@loyalz.io.
3. Who may join
- You are at least 18 years old.
- You sign up yourself and list only channels you run. Do not sign up anyone else, including creators you manage: ask them to join on their own.
4. What you agree to
- Accurate data. What you enter is true, and you keep it up to date. You can edit your profile at any time after signing in.
- Measuring your public statistics. An automated tool reads the public numbers of the channels you list: followers, views of your recent posts, and your profile photo. It reads only what anyone can see without logging in.
- Showing your profile to clients. When we put together a shortlist for a client (a casting), the client sees your display name, links, public statistics, photo, description and categories. It never sees your e-mail address or any other contact details. The client decides whether it is interested.
5. E-mails: offers and, if you want, news
The signup form has four boxes. The first three are required: you accept these terms and confirm you are 18 or older, you confirm you have read the privacy notice, and you agree that ZEST sp. z o.o. may contact you by e-mail about paid collaborations with brands. The fourth is optional and starts unticked: marketing e-mails from Zest and Loyalz with news, tips for creators and event invitations.
Contact about offers is what the base is for, so it is a condition of joining. Polish law (art. 398 of the Electronic Communications Law) requires your consent before we send such offers by e-mail. You can withdraw it at any time by deleting your profile or writing to us. Without it we cannot propose anything to you, so withdrawing it means leaving the base.
Marketing e-mails are separate. Saying no, or opting out later, does not affect your place in the base. You can switch them off in your profile or by writing to us.
6. What we promise, and what we don't
We promise that the base is free for creators. We charge you nothing, now or later, for joining or for being proposed. We show clients only what section 4 lists, and we tell you what an offer involves before you decide.
We don't promise that your signup will be accepted, that you will get an offer, or how many. The base is not exclusive for either side: you can work with any other agency or brand, and we can propose other creators.
7. Collaborations are separate agreements
Every paid collaboration is a separate agreement that sets the fee, the scope, the deadlines and the rights to the content. These terms don't create such an agreement and don't oblige you to accept any offer. Turning an offer down does not affect your place in the base.
8. Your description
You write the description yourself, up to 600 characters. Clients read it, so it must not:
- break the law or infringe anyone's rights, including copyright and other people's image;
- be offensive, discriminatory or misleading;
- contain your e-mail address, phone number or other contact details. We promise clients won't see them, and that only holds if they are not in the description.
9. Review, rejection and removal
A person at Zest looks at every signup. Until then your profile is marked “to review” and is not shown to clients. We may reject a signup without giving reasons, most often because the channels don't match what our clients look for. A rejected profile is never shown to clients, and we delete it 12 months after the rejection. You can see the status of your profile when you sign in.
We may hide or remove an accepted profile if its data is false, the channels are not yours, the description breaks section 8, or the channels no longer exist. We will tell you by e-mail and give the reason.
10. Deleting your profile
Sign in at connect.loyalz.io/dolacz and delete the profile. It is removed at once, with its statistics and photo. If you are already part of a project, the page will ask you to write to us instead. We then take you out of the base and keep only what the collaboration still needs. Records of what you ticked on the form are kept for the period stated in the privacy notice.
11. Changes to these terms
We may change these terms when the base or the law changes. Each version carries its own date-based number, shown at the top of this page. We will e-mail you a new version at least 14 days before it applies. If you don't accept it, you can delete your profile before then, and nothing else follows.
12. Complaints
Write to karol.majewski@loyalz.io, say what happened and what you expect. We reply within 14 days.
13. Governing law
These terms are governed by Polish law. If you join as a consumer, you keep the protection of the mandatory law of the country where you live, and you may bring a claim before the court that law allows. Otherwise disputes go to the court with jurisdiction over Zest's registered office.
